Suddenly, blue lights appear behind you, and an officer approaches your window, stating it is just a routine check. The questions begin: Where have you been? Where are you going? Is this your vehicle? Have you been drinking? Are you sleeping here tonight? Can we look in the back? Can you open that cupboard? What starts as a simple routine stop can quickly escalate into a rummage through your living space or vehicle. In England and Wales, police cannot search your vehicle simply because they feel like it. They cannot search your motor home just because it is unusual for you to be parked there, nor can they search it because you appear nervous or decline to answer questions. The power to stop a vehicle does not automatically grant them the power to search it; these are two distinct matters. ## Understanding Your Rights As always, remember that this is general legal information, not advice on any specific case. Under Section 163 of the Road Traffic Act 1988, a person driving a mechanically propelled vehicle on a road must stop when required to do so by a constable in uniform. This is a broad power, and you must comply. The police do not need to suspect you of any crime to stop your vehicle. These stops are sometimes referred to as stop checks or random checks. While they can check your documents and ask questions, Section 163 does not grant them the power to search your vehicle. They must have a separate reason for that. It is essential to understand the difference between a voluntary request for a search and a compulsory search. You might ask the officer, "Are you asking for my consent, or are you exercising a legal power?" This question is calm and polite, and it forces legal clarity. It allows you to maintain your rights and compels the officer to clarify their authority. ## Stop and Search Procedures Under Section 1 of the Police and Criminal Evidence Act 1984, a constable can stop and search a person or vehicle in a public place, but only if legal requirements are met. Most importantly, the officer must have reasonable grounds for suspecting they will find something that justifies the search, such as stolen or prohibited items. It is crucial to ask the officer what power they are using, what they are looking for, and what their grounds are for suspicion. The search cannot simply be an expedition to find something you should not have. A useful acronym to remember during a stop and search is "GO WISELY." - **G**: Grounds - There must be grounds for the search. - **O**: Object - There must be something specific they are looking for. - **W**: Warrant card - If they are not in uniform, they must show their warrant card. - **I**: Identity - They must identify themselves. - **S**: Station - They must inform you of the station to which they are attached. - **E**: Entitlement - You are entitled to a copy of the search record. - **L**: Legal power - They must have a legal power for the search. - **Y**: You are being detained for the purpose of a search. You may ask, "Am I being detained for the purpose of a search?"
