I've seen a lot of highly questionable letters from TV licensing over the last few years, many of which I have said come very close to crossing a line. But today I'm going to show you two letters that I think have crossed that line. Now, none of this is to be taken as legal advice; for obvious reasons, it can't be. However, I do think that these two letters cross the line, and I believe someone ought to take up a test case against TV licensing because these letters would be examples of how that might work. I'll also give you a brief reference to a previous case that I've talked about, which supports my reasoning. Two claimants were already successful in a claim for harassment against a firm sending threatening letters, where there were actually no legal proceedings in progress, and yet the letters were heavily handed.

Let’s take a look at this first letter. You can see from the big bold caption at the top with the black line underneath it: 'Action Required'. No asterisk, no qualification, no explanation—just 'Action Required'. To me, as a lawyer, that is a definitive, unqualified statement; it is an express and definitive statement. This is the kind of message you would expect if you were overdue on taxes or if your driving licence has expired. It implies that you must act immediately. It states: 'Act now to avoid a fine of up to £1,000.' This letter, along with the second one I will show you, was sent to me by one of my viewers who is increasingly worried about the aggressive tone and wording of these letters.

Just to be clear: my understanding from my viewer is that they do not require a TV licence. I’ve talked in many videos about when you need one. I may not agree with the law, but I can articulate what it is and how to comply with it. Of course, I’d never recommend that you break the law. You need a TV licence if you watch or record live TV on any device from anywhere in the world as long as it’s from a TV station or if you consume BBC content on iPlayer. So, my understanding is my viewer does not need one, making this letter erroneous. If this is more than someone should reasonably be expected to endure, it might amount to harassment. On at least two occasions, that could constitute harassment.

I think this letter is out of order. It is wrong; the caption is misleading. It is an unqualified, express statement that you must take action and obtain this licence to avoid a fine. To me, it signals threats, which makes it wrong. The other letter is even worse. Another viewer sent me another letter and is quite understandably terrified by it, which is why I'm on this mission to call out these wrongdoings. There absolutely needs to be a test case here, and I would be willing to draft some template claims to bring this sort of case, but ultimately, it would be at someone else's own risk to do so. The second letter is alarming. If the first one didn't cross the line, I believe this one does unequivocally. It states at the top: 'Enforcement Notice.'

This is highly problematic because there’s no asterisk, no qualification—just 'Enforcement Notice.' I will discuss why that’s important shortly, but for context, this kind of phrase applies in other scenarios as well; it implies real enforcement actions, which can lead to serious consequences. The letter goes on to state, 'Our records show there’s no TV licence. Therefore, an enforcement officer has been authorised to visit the property.' It warns 'You could be prosecuted.' It reinforces the aggressive tone by stating to 'Buy a licence.' They are trying to force compliance. The major issue here is that an unqualified header of 'Enforcement Notice' would give a reasonable person the impression that there are active legal proceedings, which can lead to severe consequences.

Let’s look at what an actual enforcement notice signifies under planning law. An enforcement notice is meant to provide clarity for the recipient on what constitutes a breach and what steps need to be taken. Failure to comply with such notices in a planning context is a criminal offence, and penalties can include unlimited fines. In short, actual enforcement notices relate to serious breaches that require compliance, whereas this TV licensing letter lacks any legitimate grounds for such a notice. My viewer does not require a licence; therefore, there’s no basis for enforcement here. The way to handle such matters should involve gathering evidence and pursuing a formal prosecution, not intimidation via misleading letters.
